No one seems sure as to who released this tape. It was considered privileged. Prosecutors could not have released it. It was noted that Trump team waived the privilege. Maddow thought this meant that Trump released it, trying to get ahead of the story, particularly since prosecutors could not comment, so Giuliani gets to set the narrative. Another journalist said that the Cohen team had indicated that the tape was the opposite of what Giuliani said; that Trump is heard saying that they should pay cash, which of course makes it even more nefarious, and, Cohen suggested a check. Another legal analyst said that he didn’t see why Trump would release this, there must be some other thing going on.
I think that virtually all the leaks in these matters are coming from Trump people. Mueller doesn’t leak. Prosecutors don’t leak. I doubt that Lanny Davis leaked this, to what purpose? It does distract from the treason. If this tape is privileged, then probably any other tape of this sort is, too, and it won’t be waived by the Trump team; this must be their most favorable one, such as it is. I have mixed feelings; it is a fun story, but it doesn’t do us much good, unless fraud against McDougal can be shown; and she seems to like Trump, so likely would not testify against him; plus she now has sold her story, her only goal. There was some analyst yesterday going on about how no ethical lawyer would tape his client. It is possible that their strategy is to make Cohen look so bad that whatever he says will be dismissed by the base. Actually, I don’t think that Cohen was ever Trump’s actual lawyer,, and I don’t think that any of these tapes should be privileged. You shouldn’t get to claim privilege through the ruse of having a of fixer who somehow got through a fifth-rate law school,, and calling him your lawyer when it serves your purpose, and saying he is not your lawyer when that is convenient. But the court bought it. And then it got released, and a claim of privilege was waived. Who else could have released this but Trump’s people?
At this point I really doubt Trump has any tapes. The tape probably came from the NY Field office of the FBI. Those jokers leak like sieves. Trump seems like he is having an hourly meltdown which is the best sign that things are not going well on the Russia front for him. Even if Maddow is right and Trump released them Giuliani did try to set the narrative that they were “exculpatory” but that went down in flames in short order because too many other people said no, they were not “exculpatory” Some people even believe that Cohen sent the tape out to send to a message to Trump here ya go sucker. This is just one of thousands of tapes I have of you. If you have noticed Cohen has been massively trolling Trump by hiring Lanny Davis, hanging out with Tom Arnold and Al Sharpton.
