Nothing would surprise me but I’m thinking that the relationship would have caused him to recuse himself. Not because his sons may have done anything wrong. Deutsche Bank was heavily involved in the financial collapse of 2008. They’re risk takers. But Kennedy may have been seen as having a conflict of interest or something if anything he was asked to rule on would affect the bank. Maybe that’s the angle Trump tried to push.
The strategy is OBVIOUS. Trump wants a loyalist on the court who will not stop him or call him to account for anything related to Russia. Do I trust Republicans on the hearing process? No. Do I think they will abide by their own rules? No. Would I put it passed Trump to appoint his guy without a hearing? No.
The left needs to feel it in their bones that the Republicans are extremely ruthless and unprincipled. They keep acting surprised. That’s got to stop.
Right. the thread goes a bit further that if Kennedy recused himself and then his sons are found to be implicated somehow, it would be better for HIM to have a loyalist there also (to save his sons). Only he knows what his sons have or have not done at this point (maybe even he does not — don’t ask questions, answers for which you don’t like, right?).
Republicans have no concern whatsoever about legal theories or intelligent judicial arguments, they just want the result. They would put someone on the court with no legal background, if he would vote the way they wanted, except that it would look bad and violate rules. We’ve seen the idiots that they appoint to lower courts. The people who run the Republican Party wanted to be sure they could turn a seat held by someone in his 80’s, to one held by someone in his/her 40’s, thus guaranteeing it for another 45 years or so. And they had some slight feat that the Democrats would win the Senate and then block all the nominees. So they convinced Kennedy that this was a good time to leave. And being like all current Republicans, he acceded. Deutsche Bank was probably not much of a factor. But any thought that these Republican appointees are not political , is naive. Sandra O’Connor was widely reputed to have said, “Oh, that would be awful,” when told that Gore might win the election that night. And apparently Kavanagh, high up in the potential new Justice list, called Hillary a b—. They’ve turned the court into just another political arm, we might as well disband the whole thing.

She is likely to be the pick. She is absolutely doctrinaire, not a chance she evolves into anything, except possibly even worse than she is, which is to the right of Scalia and Thomas. And Trump and his band of court packers like the idea of a far Right woman on the court, that might help them keep ,more white women’s votes next election; that cohort did vote 53% for Trump. And undoubtedly, some foolishly optimistic court watchers on the liberal side will say, “Well, she might not be so bad, let’s see.” But perhaps no this time,, because she is so bad, that, there is not a chance in the universe that she will ever rule on the right side of an issue, except maybe one of the 9-0 matters which occasionally are heard by the Court to make the Court look judicious rather than wholly ideologically and politically driven. I do hope that Hillary giving a speech to Goldman Sachs, and only being for a $12.50 floor on the minimum wage. surpassed in import what Gorsuch and the new Justice are going to do, in the minds of those who opted not to vote for her. It’s likely that this Court will ultimately rule against the legality of a minimum wage, in addition to the other New Deal legislation.
I’m sorry. Do we need another Opus Dei goddamn Catholic on the Supreme Court? How would that makeup be representative of the population?

That is interesting, I had not realized that, another Catholic on the Court. I know that there is some tradition of liberal Catholicism; most of the Kennedys, Eugene McCarthy, Mario Cuomo; but I would imagine that there is another tradition of absolutely doctrinaire Catholics who are on the Right, and who would never evolve, because their political doctrine is based on religion. That would be a very interesting article, and I would love to see you write it! But of course it is impossible to have such a debate in the Senate or the media, because we have decided that discussing the doctrines of religion is unacceptable lest it lead to prejudice.

Admitting that you were wrong is not part of our current culture. Have we seen one Sanders supporter who didn’t vote, or voted for Johnson or Stein, offer a n abject apology? No, most of them just double down, in a desperate psychological effort to prove they were right all along. Since Trump is so absolutely awful, cognitive dissonance kicks in, and people will do anything to justify voting for him, or demand that others respect that v choice, and offer blandishments to them, so that they can rationalize possibly not supporting him again. “I was an absolute idiot and did something awful which everyone is paying for now,” is unthinkable for most people, particularly in regard to politics.
There is this argument going around that it was Harry Reid who caused the Republicans to blow up the filibuster on Supreme Court Justices. That is wrong. First, Reid only got rid of the filibuster with regard to lower court appointments, and that was because the Republicans were blocking almost all of them, greatly violating the spirit of filibuster rule. And second, and more importantly, even if Reid had done nothing, McConnell would still have blown up the filibuster with regard to Supreme Court nominations. Does anyone thing he cares about precedent? Who ever refused to hold hearings for a year on a nominee? This argument is just another successful Republican effort to blame Democrats, “see what you made me do?” Republicans have been using Senate rules to essentially shut down the government until they get their way. McConnell would have made sure that Gorsuch and this next nominee would get through. It’s bad enough to see all of this, it is even more infuriating to see people who don’t understand what the Republicans are and do, seek to blame Democrats for it. If Reid had not done what he did, there would be another hundred openings on lower courts for Trump to pack with right-wing ideologues.
Father Time is inexorably prying the fingers of the Mediocre White Men off this country, and off this planet, and the world’s two greatest agglomerations of Mediocre White Men, the Russians and the Republicans (but I repeat myself) are doubling down on their grips. In a nobler cause, such tenacity might be admirable.
But they will lose in the end. I might not live to see that but it will happen.

I have a male East Coast friend who, at a bar tonight, ended up sitting next to a Trump supporter and having a real conversation. The Trump guy was disillusioned: “it hasn’t turned out like I thought.” He went on to say education was his issue, that the liberals just love that it costs so much to get an education at those fancy schools. My friend said, “so the cost of education, you don’t like it? Yeah, I can see that, I don’t like it either. I think everyone deserves to be able to go to school.” “Yeah. Absolutely.” “You think so? Even if they’re from other places, or they’re not white?” “Yeah. Of course.” “So you’re not really against people of color being able to get an education, job, contribute, raise a family?” “No. Not at all. I just want something to be directed to help me. My situation is not good. It’s like I don’t matter. Trump made it seem like I did. Nothing was about what I need or what my family needs, and it pissed me off. I wanted a change.”
They went on to talk about the cages. “Yeah, that’s not right. But we have to have strong borders!” “Yeah, but we can have strong borders without doing this s*@t, right? This is just unacceptable.” “Yeah. I don’t like it. I don’t like that. That’s just not right. This is America.” And on they went.
The guy was leaning hated-libtard, he just didn’t know it.
We (my friend and I) were talking tonight, and I was thinking of the advantage gained by a party who’s willing to absolutely demonize the other party, increase the divisions and then sneak in abhorrent things like the cages right along with the tariffs and “saving the world from nuclear war.” Get vulnerable people so freaking mad or afraid that they don’t even notice, or they figure it’s a reasonable bargain, given how crazy and sick the other side is. They’ll cheer for anything.
It’s wise to understand empathy, and the lack thereof when you see it, and we’re seeing a lot of it. At the same time, my friend had the feeling we both did when helping during Hurricane Harvey. My friend put it like this, “He was like the HH people we worked with. Salt of the earth, really good person, simple person, who didn’t understand what the consequences would really be, and wanted a change for simple reasons involving his family and being able to provide for them.” He didn’t realize change is not the same as progress.
