Bill would let doctors refuse to do abortions if Legislature OKs

The newly appointed Governor of Arizona, a republican, Jan Brewer who has a:

may get the opportunity to sign a bill proposed in the AZ legislature that:

combines provisions from a handful of anti-abortion bills vetoed by former Gov. Janet Napolitano in past years. Among them, the proposal would:

Similarly, the proposal – House Bill 2564 – would allow any hospital worker or health professional to refuse to participate in an abortion or dispense medication to abort a pregnancy.

• Require that minors seeking an abortion first receive written, notarized consent from a parent or guardian.

• Mandate a 24-hour “reflection period” before any adult woman could undergo the procedure.

• Bar any individual who is not a physician from performing a surgical abortion.

Gov. Jan Brewer became Governor after former Gov. Janet Napolitano accepted the position of Homeland Security Secretary in the Obama Administration. Arizona’s State Senate and House are controlled by Republicans.

I wonder if Barack Obama will sign the Freedom of Choice Act (like he promised) which will put this conscience rule and law business to rest. I have doubt.

The Freedom of Choice Act (H.R. 1964/S. 1173) was a bill in the 110th United States Congress which “declares that it is the policy of the United States that every woman has the fundamental right to choose to bear a child; terminate a pregnancy prior to fetal viability; or terminate a pregnancy after viability when necessary to protect her life or her health.

It prohibits a federal, state, or local governmental entity from denying or interfering with a woman’s right to exercise such choices; or discriminating against the exercise of those rights in the regulation or provision of benefits, facilities, services, or information. Provides that such prohibition shall apply retroactively.

It also authorizes an individual aggrieved by a violation of this Act to obtain appropriate relief, including relief against a governmental entity, in a civil action.”[1]

  1. As far as I know, we doctors are allowed to refuse to do an abortion if we don’t feel comfortable with it – why that needs to be a law is beyond me.

    The NOTARIZED parental consent is absolute bullshit.

    Every woman who signs up for an abortion already gets a cooling down period – you can’t just walk in and get one. Hence, another unnecessary law.

    Having seen the sometimes awful complications of botched abortions, it is probably a good idea for physicians to be the only ones performing surgical abortions. Medical abortions are another matter entirely and laws should reflect the difference.

    I suspect that Barack Obama is going to be one big disappointment when it comes to abortion rights – probably because it gives women, God forbid, some power.

  2. For all you medical people out there I have a question. Wouldn’t this bill also affect medical procedures involving ectopic pregnancies?
    While technically an ectopic pregnancy is an abortion, it is considered to be a valid procedure to save the life of the mother. Now docs dispense chemo drugs to end the pregnancy.

    It just occurred to me that this could also be a part of the conscience rule? Anyone know? Thanks.

  3. Fembots – I have been a gynecologist for 15 years and I have never seen a physician refuse to treat an ectopic pregnancy on grounds that it is a termination.

    (And I hope I never meet such a person.)

  5. Taggles – I wrote about this a while ago in a post called “The Law of Unintended? Consequences.” I was very upset to find out that Napolitano had been the only one holding up this legislation by vetoing it, and would soon be replaced by rightwing anti-freedom wacko Brewer.

    Can the FOCA really stop this nonsense? If so, we should call Obama’s office and our Congresscritters every day till he signs it.

  18. Any law that treats abortion differently from any other medical procedure is sex discrimination. If we had the ERA then sex discrimination would be unconstitutional. Of course, we don’t have the ERA, so it isn’t.

    Many years ago in Catholic school, I was taught in moral theology that the “Princple of the Double Effect” precluded terminating ectopic pregnancies. (I shook my head in horror.) Is this still true in Catholic contolled hospitals?

    Bad timing perhaps on your post, or, since most people do not live in Arizona, it might seem too foreign? ..
    However, I must say I do not think it is a question of Jan Brewer ‘ may get the opportunity” . She will get it, and will sign it.
    Please try to bring it up again. I do not post but read every day….love this blog.
