Credit card “reform”:just another hoodwink and bamboozle

monopoly chance cardThere was a time when I associated the Democratic Party with liberal ideals and considered them to be champions of the working class and the poor.  Where did that party go?  From FISA, to FOCA, to torture, to bank give-aways, to abandoning real healthcare reform, and to so-called stimulus packages that brought nothing more than increased unemployment and devastating debt to be passed on to our heirs, their actions are nothing like the party I once knew.  It wasn’t like this during the Clinton years.  Bill Clinton defined for me and many others what being a Democrat meant.  Because of Bill, I not only voted for Democrats, I fought like hell for Democratic candidates.  I gave of my time and my money – both precious – to see that as many candidates from this great party were seated in the highest offices of government. I wanted to sustain the good times for the middle class and I wrapped my hopes in the idea that someday Hillary would return to the White House and take us back to the days of peace and prosperity we had with Bill. But somewhere my party took a decidedly right turn.  They continued to wear their “D’s” but failed to maintain the precious ideals of the party; and on one issue after another, these counterfeit Dems failed us and they continue to do so, with each and every bill they pass.

As an example, let’s look at the alleged credit card reform recently signed by our president.  If past history was any indicator, his vote against interest rate caps should have been sufficient warning (remember his famous “they weren’t low enough so no cap is better than some cap” answer during the debates?), so I guess I cannot say I was surprised to see more snake oil coming from this faux Dem administration.  I was however dismayed to hear the problem defined as a consumer-driven one; because of course, as Obama says, the problem with credit cards is:

“…those who buy more than they can afford through “reckless spending or wishful thinking.”

and that

“Some get in over their heads by not using their heads,” the president said. “I want to be clear: We do not excuse or condone folks who’ve acted irresponsibly.”

Gee, President Obama, thanks for the lecture.

Maybe if he lived in the real world he’d know that there are people out here without jobs that are using their credit cards for extravagant purchases like groceries and healthcare.  Yes, it’s funny what that silly survival instinct does to people. All you irresponsible folks splurging on food and medicine can just tighten your belts and go without those luxuries.

In any event, a major part of the bill gave credit card companies a full nine months before they would have to abide by any of the changes, such as the requirement to provide advance notice before raising interest rates (In other words, they now have to stab in you in the heart not the back).  However, I guess it’s not all bad because there are some consumer protections in the bill such as:

Under the bill, a customer would have to be more than 60 days behind on a payment before seeing a rate increase on an existing balance. Even then, the lender would be required to restore the previous, lower rate if the cardholder pays the minimum balance on time for six months.

Consumers also would have to receive 45 days’ notice and an explanation before their interest rates increased.

Unsurprisingly, real reform measures such as credit card interest rate caps may happen someday, but not with this bill:

Left out of the bill, thanks to credit card industry lobbying: Two proposals to impose rate caps of 15 percent and 36 percent annual percentage rate on credit cards and other loans.

So how do you think these credit card companies are using their nine month grace period?  I’ll give you three guesses, and the first two don’t count.  Yep, they’re using this time to figure out how to gouge us even more.  I’ve already heard stories of people having their interest rates doubled during this pre-bill implementation period, and now it appears that they’ve figured out the perfect way to circumvent every pro-consumer provision of this bill and drain the last few pennies from our piggy banks.  They are accomplishing this end run by shifting away from “fixed” interests rates and moving towards variable rates.

Now, isn’t that special? But hey, we’ve still got that great guarantee of at least 45 days notice that Obama and co. put into the bill as I mentioned above, right?    Wrong.

“The changes will make it easier for issuers to bump up the rates they charge without notifying cardholders. By contrast, fixed-rate cards typically must first mail a notice to clients announcing any rate changes. The changes come at a time when issuers are rushing to comply with new legislation that will soon limit their ability to raise rates on existing balances, require them to notify customers at least 45 days in advance of any changes to their terms, and make them eliminate other confusing practices.”

So, Charlie Brown meet football – again.  But hey, who are we to complain?  The credit card problems are all our fault anyway, right?

  2. I’ve been seeing on some blogs that some people are just deliberately running the limit to the max then walking away, refusing to pay. They don’t care anymore, about their credit rating or anything. They are THAT angry. It’s a “Screw you, you can eat the loss, I’m done” mentality.

    • Yes and then there are those who are using these cards as the only source of funding for necessities like food and medicine that are being told their credit is being cut off. Where will these people go? It’s really disturbing. The ones with all the power have the rest of us up against a wall.

      The question is, what are we going to do about it. The only source of power WE have is in our numbers at the ballot box.

      • Oh, yeah. I’m not implying they are using the cards frivolously. But they are not going to kill themselves trying to pay it back, either – whereas in the past they might’ve. They are angry, and don’t feel that moral obligation to the lender that they always did before, because of how the lenders have SO screwed us.

        • I agree. They’ve hit the point of no return and see no way out. I can’t say I wouldn’t do the same if faced with some of their circumstances.

          I’m guessing most of those people are not gamers of the system, but people who have hit the end of the line economically. And that’s really devastating.

  3. Ah, the Democratic party. We have been hoodwinked. Here’s the thing, follow the money. Follow it from members of each party, follow it from members of the press, follow it from media organizations, follow it even from some celebrities. If you see the trail of money, you see the puppet strings.

    I mentioned something like this to a lobbyist acquaintance of mine and he just started laughing, until tears came to his eyes. He said yes, people think there is a difference between the parties. Aren’t they just so precious he laughed. He even laughed at how people are continually told to just follow the money but they don’t. They really just don’t want to know how it really works.

    That’s the best thing they have going, people really don’t want to know. I think they know they can’t handle it if they really knew how it all worked. It’s not unlike the level of corruption we see in police forces like dkat has run into. It’s just too horrible to deal with so people chose to not see it.

  4. Don’t “help” us any more Congress! Please! Don’t “help” us with our debt by making it impossible to pay off! Don’t “help” us get health care by forcing us to buy private insurance! Don’t give any more of our tax dollars to billionaires to “help” whatever that was supposed to help! Just go back to being the do-nothings you were before the ADD President came along. You are doing too much, too fast and too poorly! Go on a long vacation somewhere in the US-at least you would be “helping” the economy for real!

      • I don’t know about that Ralph. There are a lot of good federal workers out there that take the brunt of criticism for the acts of the bozos in DC.

        • That’s true and always will be but it doesn’t negate the bad feeling, which was my point. Also in the past, some decisions could be made locally but now, with the increasing bind of regulations on government workers, it seems the local worker has no authority to do anything that’s the least outside the box.

          I put that down to too damn many lawyers and the powers that be not trusting the people who work in their agencies.

    • Great video! My son heard the music and kinda gave me a look! Nice to see both parties share the praise and blame for a change. Like seeing AIG etc. in the cross hairs. I really became a Brad Sherman fan when the House was debating TARP. Geithner is full of it as usual.

  8. Believe it or not, one of my friends was delighted that Obama had stuck up for the people in dealing with the credit card situation. I did respond by saying,” Yes, he’s done so much. At least you will know in advance how much your interest will go up. That will truly help the struggling class.” Needless to say, there was no response.

  11. I don’t have much credit, and the little credit I have is so bad, they won’t even take my cash.
    I am trying to pay for a College Education, and I also have other bills, and I make next to nothing at my crappy part time job. My pay checks are so pathetic, I can barely afford to wipe my a$$. I live off of mac and cheese, and until recently I was driving a tin can that I had to start with a screw driver. It was so ghetto, I got pulled over in a small town for no reason and the cops called back up because they thought I stole my own car, which they then searched for drugs.
    Such is life as a student, and there are millions of others like me. Yes, a lot of us do use credit cards for necessities like food, gas, and car insurance. There is just no other way to pay for those things.
    That is what it is like now. I talk to people who are older than me, who went to College during the Clinton years, and they all say they feel for me. It was much easier back then, when gas was fifty cents a gallon, ect.
    I was a kid when Bill was President, but I remember it well enough. Had his policies continued after he left office, I would be in a lot better shape right now.

  12. It’s downright criminal what some of these companies are doing. The whole credit industry is a big scam. Then they rip you off more trying to sell you credit protection and credit monitoring and if you refuse to purchase it I swear they deliberately put things on your credit report that don’t belong to you. Consumers have no protections at all, seriously, we were better off when the mob was loaning people money.

  15. The biggest BS of the 0bama rhetoric is that Mr. responsibility himself bought a house he couldn’t afford, but he had access to a criminal to pay for a third of it. (Ooops, he just said it was a bonehead mistake) He didn’t need credit card reform or mortgage bailout…not when you have the likes of a Tony Rezko. Or the Federal Govt allowing him a blank checkbook for his whims and obscene needs.

  16. Exactly! They don’t call Biden “Credit Card Joe” for nothing.Remember the bankruptcy Legislation? That was Mr Biden. It made it impossible to get out from under debt brought on by catastophic circumstances such as you all have described. When you use a credit card to pay for an Emergency Medical Procedure as an example or you need medication. I’ve taken medications that cost over a thousand dollars a month. At one time, I had to pay for it myself because I was between coverage. It killed my credit. The fees for late payments that put you over the limit that generates another fee for being over the limit and on and on. Its a snowball of debt rolling down the hill getting larger and larger with nothing to stop it. I always wondered where the Consumer Protection came in. There is none. The Protection is all for the likes of Goldman Sachs. Look at Obama’s economic team.They all come from that same company.

    • yep, when Credit Card Joe was being chosen as VP … that’s when I knew it was all over for the protection of the consumer. & this “reform” is just another hole in the bucket to sink us even more, just like the “Bankruptcy Reform Act” in 1998 and its subsequent monster when they renewed it.

      And remember when during a press conference on the stimulus, Obama made constant references to Jamie … said to the effect of “I’ll speak to Jamie about this” … Who was that illustrious Jamie? Jamie Dimon from the Chase Bank board of directors.

  18. I just hope that Americans will finally wake the #$@% up and through the bums out. No incumbents 2010. Eventually the marks have to catch on to the shell game. (I hope.)
